What to Expect at Arraignment

Your first court date is the arraignment. The judge reads the charges, confirms you have counsel (or appoints one if you qualify), and sets conditions of release. If you have private counsel, most arraignments can be waived in writing — saving you a trip to court.

Pretrial Conference and Disclosure

After arraignment, the court sets a pretrial conference. This is where your attorney receives disclosure from the prosecutor — the police reports, breath or blood test records, dash-cam and body-cam video, and officer certifications. Most defense leverage is built at this stage.

Motion Practice and Plea Negotiation

Mesa prosecutors have their own charging policies and plea tendencies. An experienced DUI attorney who practices regularly in this court will know how the city attorney's office tends to handle challenges to the stop, SFST administration, and breath test foundation.
